Cash Flow Projections
We have worked with the special assets department of the major financial institutions in California. Our involvement has been on syndicated as well as smaller deals. Our work on behalf of the banks has been in various industries, including manufacturing, construction, agriculture, computers and distributor services.
What We Did:
On behalf of a major bank’s Special Assets Department, we analyzed cash flow projections prepared by a large construction company. We met with the project managers to determine how they accounted for the various construction projects. We prepared an analysis, which allowed the bank to work out a settlement of the outstanding debt with the company.
We visited a distributor of computer equipment that began depositing millions of dollars of customer checks that were returned for non-payment. Based on our work, the bank discovered that the company was falsifying financial information and diverting cash flow from the company to related parties. The case was eventually presented to the federal authorities for action.

Defense of Malpractice

What We Did:
We obtained the appropriate business records of the five entities involved, analyzed these records for the relevant 10-year period and developed schedules which clearly showed the source and disposition of funds. Counsel used these schedules to demonstrate how the defendants did not misappropriate any funds.
The matter was settled favorably to our client.
Loss of Profit Entertainment Suit
A motion picture producer was pursuing a lost profits suit as plaintiff.
What We Did:
Using the defendant’s records, which were maintained in several locations in the U.S. and Europe, we computed the “profits” on the motion picture in question. Then, using that basic calculation, we recalculated profits with differing sets of assumptions to best conform the defendant’s results to the way our client did business. The result was a settlement in our client’s favor in tens of millions of dollars.
